Wisconsin Assembly Rep. Brill bill mandates restitution payments, clarifies voting rights restoration

Passed bill authored by State Rep. Lindee Rae Brill seeks to prioritize financial restitution after human trafficking convictions and clarify conditions for restoring voting rights to individuals with felony convictions, according to the Wisconsin State Assembly.

It passed both chambers as of June 18, clearing the Assembly by a vote of 53-44 and the Senate by a vote of 18-14.

However, Gov. Tony Evers vetoed the bill on Aug. 11.

The bill, introduced as AB87 on Feb. 28, during the 2025 session, was summarized by the state legislature as follows: "restitution orders following a conviction for human trafficking and restoration of the right to vote to a person barred from voting as a result of a felony conviction. (FE)".

The following is our breakdown, based on the actual bill text, and may include interpretation to clarify its provisions.

In essence, this bill mandates immediate restitution payments following a conviction for human trafficking, requiring the court to issue an execution against the defendant's property if payments are not made promptly. It also clarifies the restoration of voting rights for those with felony convictions. An individual's right to vote is restored only after completing their prison term or probation, settling all associated fines, fees, or restitution, and fulfilling any community service mandated by the court. These changes aim to ensure financial responsibilities linked to crimes are prioritized, emphasizing restitution enforcement and comprehensive compliance for voting restoration.

In the Assembly, 53 Republicans voted in favor while 44 Democrats opposed it.

Meanwhile, in the Senate, 18 Republicans voted in favor while 14 Democrats voted against it.

Representatives Sortwell, Brill, Dittrich, Duchow, Gundrum, and five other legislators introduced the bill in the Wisconsin Assembly on Feb. 28 during the 2025 legislative session. The bill was also co-authored by Sen. Dan Feyen (Republican-20th District), Rep. Barbara Dittrich (Republican-99th District), Rep. Cindi Duchow (Republican-97th District), Rep. Rick Gundrum (Republican-58th District), and Rep. Daniel Knodl (Republican-24th District).

Brill, a Republican, was elected to the Wisconsin State Assembly in 2025 to represent the state's 27th Assembly district, replacing previous state representative Amy Binsfeld.
